These Terms of Service ("Terms") constitute a legally binding agreement between you and Breaking The Algorithm LLC ("JARVIS," "we," "us," or "our") governing your access to and use of jarvis-edu.com and the JARVIS Homeschool Command Center platform (the "Service").
By creating an account, subscribing to the Service, or otherwise using the platform, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the Service.
To create a parent or guardian account, you must be at least 18 years of age and have the legal authority to enter into this agreement on behalf of yourself and your household.
Children's accounts may only be created by a registered parent or guardian. By creating a child's account, you represent that you are the parent or legal guardian of that child and that you consent to our collection and use of that child's information as described in our Privacy Policy, including the COPPA disclosures therein.
The Service is intended for use by families in the United States. Use of the Service from outside the United States is at your own risk and subject to applicable local laws.
JARVIS Homeschool Command Center is a subscription-based digital platform that provides:
We reserve the right to modify, add, or remove features of the Service at any time. We will provide reasonable notice of material changes that adversely affect your use of the Service.
JARVIS is an educational support tool. It is not a licensed school, accredited institution, or certified curriculum provider. Parents are solely responsible for their home education program and for compliance with applicable state and local law.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@jarvis-edu.com if you suspect unauthorized access to your account.
Children access the platform using a 6-digit numeric PIN assigned by the parent. You are responsible for keeping your child's PIN confidential and for all activity under your child's account.
You may not share your account with persons outside your household, transfer your account to another person, or use the Service to provide access to families other than your own without upgrading to an eligible co-op plan.
Access to JARVIS requires an active paid subscription. Plan details, pricing, and features are described on our pricing page. We offer Family plans (single household) and Co-op plans (multiple households) at multiple tiers. All prices are in U.S. dollars and are subject to applicable taxes.
Subscriptions are billed monthly on a recurring basis. By subscribing, you authorize us to charge your payment method on file through Square on each billing date. You must maintain a valid payment method to maintain active access.
If a payment fails, we will attempt to notify you by email. Access to paid features may be suspended until payment is resolved.
You may cancel your subscription at any time by contacting us at support@jarvis-edu.com or through the billing management tools in your parent portal. Cancellation takes effect at the end of the current billing period. You will retain access to paid features through the end of the period for which you have already paid. We do not provide partial-period refunds.
We do not offer refunds except where required by applicable law. If you believe a charge was made in error, contact us within 30 days of the charge at support@jarvis-edu.com and we will review your request.
We may change our subscription prices at any time. We will provide at least 30 days' advance notice of a price increase by email to your registered address. Your continued subscription after the effective date of a price change constitutes your acceptance of the new price.
Newly registered accounts are provisioned at a free preview tier that allows access to the parent portal interface but does not include curriculum access, student seat allocation, or premium features. The preview tier is provided as-is and may be modified or discontinued at any time.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these restrictions, without refund.
The JARVIS platform, including its software, curriculum content, lesson designs, graphics, trademarks, and the "JARVIS Homeschool Command Center" name and brand, is owned by Breaking The Algorithm LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or sublicense any part of the platform without our express written permission.
You retain ownership of all data you upload or generate through your use of the Service, including your child's progress records, parent-entered intake information, and educational portfolios. By using the Service, you grant us a limited, non-exclusive license to store, process, and display that data solely as necessary to provide the Service to you.
We do not claim ownership of your educational records. Upon account deletion, we will delete your data within 30 days as described in our Privacy Policy.
Curriculum content delivered through the platform is licensed to you for personal, non-commercial, household educational use only. You may print or save content for your family's home education use. You may not redistribute, resell, or publicly post curriculum content.
JARVIS provides tools designed to support compliance with Florida Statute §1002.41 and similar home education laws, including lesson recordkeeping and annual evaluation documentation generators. However:
Our total liability to you for any claim arising out of or relating to these Terms or the Service, regardless of the form of the action, is limited to the greater of (a) the total amount you paid to us in the twelve (12) months immediately preceding the claim, or (b) one hundred dollars ($100.00).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Breaking The Algorithm LLC and its members, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit to the Service.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration in Miami-Dade County, Florida, under the rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
We may suspend or terminate your account and access to the Service at any time for violation of these Terms, non-payment, or at our discretion with reasonable notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimer of warranties, limitation of liability, and dispute resolution.
You may terminate your account at any time by contacting us at support@jarvis-edu.com.
We may modify these Terms at any time. When we make material changes, we will notify you by email and update the "Effective Date" at the top of this page at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must cancel your subscription and stop using the Service before the effective date.
Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Breaking The Algorithm LLC regarding the Service and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
